Appellate Law

Our appellate practice at Parnell, Michels & McKay is focused on civil appeals. We can assist in cases where a court may have overlooked law or key facts in making a decision. The Appellate process will not allow you to re-litigate your case, but it can give a client an opportunity to reverse an unjust decision. The cases we accept include all state circuit court and superior court appeals following a final decision from the trial court (also called “Mandatory Appeals”). Appeals are different than trials in that the legal issues are highly focused and technical. Our appellate counsel provides comprehensive researched and well-defined legal arguments that are written as briefs for the Supreme Court. If necessary, an oral argument will take place, and the attorneys at Parnell, Michels & McKay will be well-versed in your legal position for any oral arguments to help you win your case.

However, appeals are not right in all cases. At Parnell, Michels & McKay, our attorneys make sure that our clients understand the process of an appeal, explain the relevant law, how the case will be argued, and whether an appeal makes sense for you.

Appealing the decision of a lower court has strict time limitations. You must act quickly if you are considering an appeal.
